AN E-WORKSHOP
on
“Public Interest Litigation: Decentralization and Its Importance” by K. K. Rai, Senior Advocate
An E-workshop was conducted on 3rd June 2022 under the MARG Virtual Legal Literacy Programme. The E-workshop outlined the meaning and the features of Public Interest Litigation by defining it’s as non adversarial litigation. In this E-workshop sources of Public Interest Litigation were discussed by evaluating Constitutional Provision of our country like Preamble, Article 39A, and Article 51A. This E-workshop had also emphasized on the significance of Public Interest Litigation at large by advancing that growth of PIL is closely linked with our constitutional goals. The growth of Public Interest litigation in India were also got discussed in this session by tracing all the three phases and their dominating areas. The E-workshop had also thrown light on the expansion of the scope of locus standi in India. Besides, covering all the general aspects of Public Interest Litigation the E- Workshop had mainly emphasized on the concept of decentralization of Public Interest Litigation in India and its significance by interpreting Section 91 of Civil Procedure Code and Section 133 Criminal Procedure Code.
The sole motto of this E-workshop was to aware the general public at large, that apart from the constitutional courts, Public Interest Litigation can also be filed at lower courts, as provided by the legislation under the various provision of law.
